Terms and conditions for processing personal data

1. GENERAL SPECIFICATIONS

SC CONTAINERE FDC SRL is a personal data operator and exercises this capacity in accordance with Regulation (EU) 679/2016 of the European Parliament and of the Council of April 27, 2016 regarding the protection of natural persons with regard to the processing of personal data and regarding the free circulation of this data and repealing Directive 95/46/CE (General Data Protection Regulation - RGPD) and Law 190/2018 regarding measures to implement the RGPD.

1.1 Definitions

1."personal data" means any information regarding an identified or identifiable natural person ("data subject"); an identifiable natural person is a person who can be identified, directly or indirectly, in particular by reference to an identification element, such as a name, an identification number, location data, an online identifier, or to one or more many specific elements, specific to his physical, physiological, genetic, psychological, economic, cultural or social identity;

2. "processing" means any operation or set of operations performed on personal data or sets of personal data, with or without the use of automated means, such as collection, recording, organization, structuring, storage, adaptation or modifying, extracting, consulting, using, disclosing by transmission, disseminating or otherwise making available, aligning or combining, restricting, erasing or destroying;

3. "operator" means the natural or legal person, public authority, agency or other body that, alone or together with others, establishes the purposes and means of personal data processing; when the purposes and means of processing are established by Union law or domestic law, the operator or the specific criteria for its designation may be provided for in Union law or domestic law;

4. "person authorized by the operator" means the natural or legal person, public authority, agency or other body that processes personal data on behalf of the operator;

5. "recipient" means the natural or legal person, public authority, agency or other body to whom (to whom) the personal data are disclosed, regardless of whether it is a third party or not. However, public authorities to whom personal data may be communicated within a certain investigation in accordance with Union law or internal law, are not considered recipients; the processing of this data by the respective public authorities complies with the applicable data protection rules, in accordance with the purposes of the processing;

5 "data subject" is the person whose personal data are processed.

6. "consent" of the data subject means any manifestation of free, specific, informed and unambiguous will of the data subject by which he/she accepts, through a statement or an unequivocal action, that the personal data concerning him/her to be processed;

7. "personal data security breach" means a security breach that leads, accidentally or illegally, to the destruction, loss, modification, or unauthorized disclosure of personal data transmitted, stored or otherwise processed, or to unauthorized access to them;

8. "targeted supervisory authority" means a supervisory authority that is targeted by the processing of personal data because:

(a) the operator or the person authorized by the operator is established on the territory of the member state of the respective supervisory authority;

(b) the persons concerned who reside in the member state where the respective supervisory authority is located are significantly affected or are likely to be significantly affected by the processing; or

(c) a complaint has been submitted to the respective supervisory authority;

This privacy policy explains the manner in which SC CONTAINERE FDC SRL processes the personal data of the person concerned, how it is carried out, for what purposes and who is the recipient.

SC CONTAINERE FDC SRL is committed to respecting the confidentiality of your personal data. We will treat all personal data provided by you as confidential and we will only process the information permitted by applicable law.

This privacy notice describes the organization's policies and practices regarding the collection and use of your personal data and confirms your privacy rights.

4. HOW WE PROCESS PERSONAL DATA 4.1. The personal data that are processed:

 We can process the following types of personal data:
- Any information related to an identified or identifiable natural person such as:

name, surname, address, identity card series and number, CNP, financial data, date of birth, telephone number, email address, data regarding health status, identification data.

– information about your computer and about your visits and use of this website (including your IP address, geographic location, browser type and version, operating system, referral source, duration of visit, page views and navigation paths of website);

– the information contained in or related to any communication you send us through this site (including correspondence with us, the content of the communication and the data associated with the communication);

The processing is legal, according to the provisions of art. 6 of Regulation no. 679/2016, only if and to the extent that at least one of the following conditions applies:

- the data subject has given his consent for the processing of his personal data for one or more specific purposes;

- the processing is necessary for the fulfillment of a task that serves a public interest or that results from the exercise of the public authority with which the operator is vested;

- the processing is necessary for the execution of a contract to which the data subject is a party or to take steps at the request of the data subject before concluding a contract;

- the processing is necessary in order to fulfill a legal obligation that belongs to him

the operator;

- processing is necessary to protect the vital interests of the data subject or another

individuals;

6. DISCLOSURE AND TRANSFER OF PERSONAL DATA

SC CONTAINERE FDC SRL strives to apply adequate guarantees to protect the confidentiality and security of your personal data, to use them only in accordance with your relationship with our company and with the practices described in this Privacy Policy.

To the extent permitted by applicable data protection laws, we may disclose your personal data to partners, auditors, agencies, state institutions, supervisory authorities or other external service providers in order to fulfill our contractual obligations. We will clearly indicate for you each recipient of data if it is known at the time of initiation of processing.

- The right to access and information - you can request information regarding the processing activities of your personal data;

- The right to rectification - you can correct inaccurate personal data or complete them;

- The right to delete data ("the right to be forgotten") - you can obtain the deletion of data, if their processing was not legal or in other cases provided by law;

- The right to restrict processing - you can request the restriction of processing if you dispute the accuracy of the data, as well as in other cases provided by law;

- The right to data portability - you can receive, under certain conditions, the personal data you have provided us, in a format that can be read automatically or you can request that the respective data be transmitted to another operator;

- The right of opposition - you can file a complaint against the method of personal data processing at the National Authority for the Supervision of Personal Data Processing;

– The right to withdraw consent;

– The right not to be subject to a decision based exclusively on automatic processing, including

creating profiles:

8. STORAGE OF PERSONAL DATA

Your personal data is stored by SC CONTAINERE FDC SRL on its own equipment. The personal data that we process, based on your consent, will be kept for the period of its validity (or until the consent is revoked), unless the applicable legal requirements provide otherwise and this is necessary for the purpose processing.

Without prejudice to the other provisions of this section, we will keep information and documents (including electronic documents) that contain personal data:

– to the extent that we are obliged to do so by law;

- if the information / documents are relevant for any ongoing or potential judicial procedure;

– to establish, exercise or defend our legitimate rights (including providing information to other people for the purpose of fraud prevention).

9. SECURITY OF PERSONAL DATA

In order to protect the confidentiality of your data and personal information, we will maintain physical, technical and administrative protection measures.
